These Terms of Service (“Terms”) govern your access to and use of the OpenPitch mobile application, websites, and related services (the “Services”). The Services are operated by Sports Synergies, Corp., a Connecticut corporation. In these Terms, “OpenPitch,” “we,” “us,” and “our” refer to Sports Synergies, Corp., doing business as OpenPitch.
By using the Services, you agree to these Terms.
The Services are intended for adult participants and authorized representatives of teams, leagues, associations, referees, and businesses. You must be able to form a binding contract to use the Services.
You are responsible for: - Maintaining the confidentiality of your credentials - All activity under your account You agree to provide accurate information and keep it updated.
Some features are role based (player, referee, team manager, league administrator, association administrator, business). If you act on behalf of a team, league, association, or business, you represent that you have authority to do so.
The Services may include: - Registration and roster management - Payments, dues collection, and transaction tracking - Digital identity, eligibility, and conduct related workflows - Communication features for participants and administrators - Marketplace listings, sponsor activations, and offers
Features may change over time.
You agree not to: - Violate any law or regulation - Impersonate others or misrepresent affiliation - Harass, threaten, or abuse others - Interfere with the integrity or security of the Services - Upload malware or attempt unauthorized access We may remove content or restrict access for violations.
Certain Services require payment. Payments may be processed by third party processors and may be subject to their terms.
Fees may include registration fees, team dues, transaction fees, marketplace fees, or subscription fees, depending on the feature.
Refund policies are determined by the applicable league, association, event organizer, or seller unless otherwise stated. OpenPitch may provide tooling to support refunds, but the responsible party is determined by the context of the transaction.
If you create listings or offers, you are responsible for: - Accuracy of listing content - Compliance with applicable laws - Customer fulfillment and support OpenPitch may remove listings that violate these Terms or applicable rules.
The Services, including software, branding, and content provided by OpenPitch, are owned by OpenPitch or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or pose a risk to the Services or other users.
The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted operation or that the Services will be error free.
To the maximum extent permitted by law, OpenPitch will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Our total liability for any claim related to the Services is limited to the amount you paid to OpenPitch for the Services in the 12 months before the event giving rise to the claim, or $100 if you paid nothing.
These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles.
